MINUTES OF THE PUBLIC MEETING OF MAY 13, 2015
TOWN HALL, 542 LIBERTY STREET, HANSON, MA

Called to Order at 7:00 PM under M.G.L. c 131, §40 and the Hanson By-Law 3-13, §5 and Rules and Regulations by John Kemmett, Chairman, in Meeting Room A at the Town Hall.

Public Hearings

7:15 PM  Notice of Intent for a proposal to repair a septic system at 6 Upton Street, Map 2, Lot 346 for Jane Tsoumas represented by Grady Consulting, LLC (DEP #SE175-0662)  (New Hearing)

        Mr. Kirlin read the Public Hearing Notice and the abutters were verified.  Mr. Darren Grady, P.E. made the presentation for a proposed septic repair.  He submitted a Plan dated 5/11/2015 depicting a 7,200 sq.ft. lot with an intermittent stream, delineated by South River Environmental, that runs underground through the middle of the property.   He added that the removal of a cesspool to install a pump system was a “significant upgrade from the existing system.”  Mr. Schellenger asked if there was an easement for the drainage pipe as the Town should be concerned whether it’s part of their system.  Ms. Muncy suggested that it’s a good opportunity to open up a dialogue with the Selectmen in regards to drainage easements.  

Motion to continue until May 26, 2015 at 7:30 PM pending a Mitigation Plan, Board of Health approval and a letter to the Selectmen regarding obtaining a drainage easement:  Frank Schellenger

7:30 PM  Request for Determination of Applicability to determine the accuracy of a wetland delineation at 172 Indian Head Street for Stephen Corbeels, Trustee represented by Vautrinot Consulting, P.O. Box 144, Plympton, MA  02367 (New Hearing)

        Mr. Kirlin read the Public Hearing Notice. However the abutters had not been notified so the hearing was deemed invalid.  A new hearing was to be rescheduled to June 9, 2015 at 7:45 PM.  Mr. Don Ellis, who was present, asked if William Woodward, the Wetland Scientist who delineated the resource areas could meet with the Commission’s consultant, Mr. John Delano.  Mr. Kemmett answered that Mr. Delano should conduct an independent review and if there were discrepancies, they would be discussed at a Conservation meeting.

Discussions

Conservation Agent:  Board of Health Perc Test procedure discussion
        Ms. Muncy reported that a complaint had been made about inter-office procedure between the Board of Health and Conservation offices regarding perc testing.  Ms. Muncy will be attending the next BOH meeting to defend the current procedure as it was created to alleviate the permitting process by making it less arduous for residents.  She urged the Commission to attend the BOH meeting on 5/29/2015.  

Memorandum of Agreement for Monponsett Ponds  
        Ms. Nehiley commented that Aquatic Control, the Company responsible for the treatment of East and West Monponsett Ponds on behalf of the Town of Halifax is looking for confirmation that the Order of Conditions from Hanson (DEP #SE175-0580) is extended for 4 years under the Extension Permitting Act (Sections 74 and 75 of Chapter 238 of the Acts of 2012, the Acts) by signature of a Memorandum of Agreement.  It appears that the Memorandum is a requirement for the company to obtain a License for Aquatic Nuisance Control from the Department of Environmental Protection.
        Mr. Schellenger is of the opinion that the Aluminum Sulfate treatment being proposed is a temporary stop-gap measure and they haven’t addressed the real problem.  He is not in favor.  Mr. Kemmett commented that Aquatic Control is not in compliance with the Order of Conditions and requested that they come in to explain their current plan of action.

Conservation Fund – proposed expenditures for property management in FY2015
        Ms. Muncy reported that Mr. Clemons was advocating to the Commission to hire the Goatscaping Company out of Plympton to address the poison ivy problem at the Poor Meadow Conservation Area so that trail blazing can commence at the property.  The company had submitted an estimate last August, but a decision was tabled.  Mr. Kemmett suggested that we have a little more information and a management plan in place before scheduling anything.
